Burning Regulations - 2011
 
General:  A person shall not kindle, maintain, or authorize to be kindled or maintained any open burning unless conducted and approved by the Fire Department.
 
Prohibited Open Burning:  Open burning that is offensive or objectionable because of smoke or odor emissions or when atmospheric conditions or local circumstances make such fire hazardous shall be
Prohibited.
 

Closed Fire Season:  Permits will be required during closed fire season, May 10th through October 20th of each year.  Burning permits are available by contacting the Kellogg or Pinehurst Fire Stations, 784-1188 or 682-2625 or the Idaho Department of Lands office in Kingston, 682-4611. 

 

Open Burning Season:  During the period of October 21st through May 9th of each year no permit is required.  Whereas a permit is not required, the Fire Department shall still be notified.

 

Authorization:  Where required by state law or regulations, open burning may require additional notification to the Idaho Department of Lands (IDL), Department of Environmental Quality (DEQ), or the Panhandle Health District.

 

Extinguishment Authority:  Shoshone County Fire District No. 2 will order the extinguishment by the permit holder, another person responsible or by the Fire District of open burning that creates or adds to a hazardous or objectionable situation.

 

Location:  The location for open burning shall not be less than 50 feet from any structure, and provisions shall be made to prevent the fire from spreading to within 50 feet of a structure.

 
            Exceptions: 

1.                   Fires in approved containers that are not less than 15 feet from a structure.

2.                   The minimum required distance from a structure shall be 25 feet where the pile size is 3 feet or less in diameter and 2 feet or less in height.

 

            Bonfires:  A bon fire shall not be conducted within 50 feet of a structure or combustible material             unless the fire is contained in a barbecue pit.  Conditions, which could cause a fire to spread within             50 feet of a structure, shall be eliminated prior to ignition.

 

            Recreational Fires:  Recreational fires shall not be conducted with in 25 feet of a structure or             combustible material.  Conditions, which could cause a fire to spread within 25 feet of a structure,             shall be eliminated prior to ignition.

 

Attendance:  Open burning, bon fires, or recreational fires shall be constantly attended until the fire is extinguished.  A minimum of one portable fire extinguisher complying with a minimum 4-A rating or other on-site fire-extinguishing equipment such as dirt, sand, water barrel, garden hose or water truck, shall be available for immediate utilization.

 

Logging Slash:  All logging slash is under the jurisdiction of the Idaho Department of lands, 682-4611.
